13.04.2021 ss W.P.A. 4257 of 2020 Sudhir Chandra Sau Vs.

The State of West Bengal & ors.

Mr. Sarwar Jahan Mr. Sudipta Maiti Ms. Pritikana Gantait ...

for the Petitioner Mr. Gautam Basu ... for the State Mr. Gautam Basu, learned Counsel appearing on behalf of the State-respondents submits that the District Inspector of Schools (S.E.), Purba Medinipur (in short, 'the D.I. of Schools') has recommended the case of the petitioner to the Director of Pension, Provident Fund and Group Insurance (in short, 'the D.P.P.G.'). However, he does not have any instruction from the D.P.P.G.

Accordingly, Counsel for the State submits that necessary order may be passed so that the D.P.P.G. may act on the recommendation of the D.I. of Schools. In light of the above submissions, the D.P.P.G. being the respondent no.4 is directed to include the name of Shyamali Pal, wife of the petitioner, as nominee in the Pension Payment Order within a period of six weeks from date.

In light of the above, this writ petition is disposed of.

Since no affidavit-in-opposition is called for, allegations made in the writ petition are deemed not to have been admitted.

All parties are to act on website copy of this order. (Shekhar B. Saraf, J.)
