Petitioner is aggrieved by the fact that the petitioner has been thrown out by his son and daughter-in-law from the business premises and is further restrained from carrying on the business. Petitioner has informed the police authorities and subsequently criminal cases were registered pursuant to such complaints. Petitioner has also made an application before the SubDivisional Officer, Lalbagh, Murshidabad who is in seisin of the proceedings under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. Specific prayers have been made before the SDO.

It has been submitted that the next date is fixed on 08.04.2025. The concerned SDO is directed to pass directions in terms of the prayers advanced by the petitioner after hearing all the parties. So far as the police authorities are concerned until and unless SDO passes any order, police authorities are not in a position to interfere with the prayers so advanced before this court. In case there are orders passed by the SDO, police authorities would respect, obey and implement such orders.

Police authorities however will ensure that there is no breach of the peace and/or tranquility and/or any other further untoward incident resulting because of the inimical relationship existing between the parties.

With the aforesaid observations WPA 5310 of 2025 is disposed of.
