The petitioner is an Assistant Teacher of Podhra Md. Hossain Junior High School, DistrictBirbhum. The petitioner is prying higher scale of pay for enhancement of his qualification.

The petitioner complains that his prayer for such enhancement of pay scale is pending consideration for a long time before the District Inspector of Schools (S.E), Birbhum, the respondent no. 3 herein.

Mr.

Chattopadhyay, learned Additional Government Pleader submits that representation annexed with the writ petition is of June 14, 2018, therefore, the petitioner is required to file a fresh representation for the relief as prayed for.

The petitioner is granted liberty to file a fresh representation before the respondent no. 3 for

consideration of his prayer for higher scale of pay for enhancement of his qualification.

If such a representation is made within a week from date, the respondent no. 3 shall consider and dispose of the same in accordance with law within a period of four weeks from the date of submission of the said representation after giving an opportunity of hearing to the petitioner and other concerned parties.

Since no affidavit-in-opposition is invited, the allegations made in the writ petition are deemed to have been denied by the respondents.

W.P.A. 6092 of 2021 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
