The petitioner has preferred a second appeal under the provisions of Section 19(3) of the Right to Information Act, 2005 before the State Chief Information Commissioner, West Bengal State Information Commission, having his office at Khadya Bhawan, 11A, Mirza Ghalib Street, Kolkata -700087 on 18th September, 2020. The petitioner is aggrieved by the act of the said State Chief Information Commissioner failing to dispose of the second appeal despite lapse of about six months from the date of filing of the same.

Owing to the present scenario, the six months time, which has elapsed in between, cannot be said to be an inordinate delay in disposing of the appeal.

In the facts and circumstances as aforesaid, after hearing the parties, it appears that justice will be subserved if the West Bengal State Information Commission is directed to dispose of the said second appeal filed by the petitioner on 18th September, 2020 as expeditiously as possible but within 31st July, 2021.

The petitioner shall communicate this order to the West Bengal State Information Commission.

The respondents are represented.

The respondents shall also inform the said West Bengal State Information Commission about the instant order. Nothing further remains to be adjudicated in this writ petition. The same is disposed of accordingly without any order as to costs.

Since I have not called for any affidavits, allegations made in the writ petition are deemed to have not been admitted.

Urgent photostat certified copy of this order, if applied for, is to be given to the parties, upon compliance of necessary formalities.
