The petitioner has filed the present writ application praying for a direction upon the respondent no. 3 to consider the request of the petitioner for grant approval for renal transplantation of the petitioner who has been diagnosed with End Stage, renal disease and is in urgent need of kidney transplantation.

Learned counsel for the petitioner submits that the petitioner is aged about 28 years and is presently pursuing MSc. In Zoology from Ballygunge Science College. The petitioner is diagnosed with bilateral chronic renal parenchymal disease and is continuous under medical treatment with the Narayana Multispeciality Hospital Pvt. Ltd.

The private respondent no. 7, Abhijit Das being the neighbour is ready and willing to donate the kidney to the petitioner and has submitted all the documents including the affidavit executed before the Magistrate and the matter has been placed before the Committee for consideration but till date the authorities have not considered the request made by the petitioner.

Learned counsel appearing for the respondent raised objection and submits that the Narayana Multispeciality Hospital has given a certificate wherein it is mentioned that the donor has to obtain the Domicile Certificate from the Administrative Officer of the Government of West Bengal. The petitioner has brought to the notice of the Domicile Certificate of the wife of the donor issued by the concerned authority.

Learned counsel for the petitioner submits that the petitioner has submitted all the required documents to obtain approval from the competent authority for renal transplantation but in spite of the same, till date the application has not been considered.

Considered the submissions made by the learned counsel for the respective parties.

This Court finds that the petitioner has made an application before the respondent no. 3 on July 14, 2025 along with all documents but till date the request of the petitioner has not been considered.

Considering the above, the writ petition is disposed of by directing the respondent no. 3 to consider the representation submitted by the petitioner dated July 14, 2025 along with all documents and the affidavit submitted by the donor and his wife and to take appropriate decision for grant of approval for renal transplantation within a period of four weeks from the date of receipt of this order.

WPA 5563 of 2026 is disposed of.

10. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
