Learned advocate appearing for the petitioner submits that the petitioner is a driver who has been implicated in connection with the instant case while the owner of the vehicle has not been made accused. It has been further submitted that the petitioner is in custody for more than ten months. As such, petitioner prays for bail on any stringent condition.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the alleged recovery is of 59.11 kgs. of ganja/contraband. Having considered the quantum of recovery of contraband, at this stage, I am not inclined to release the petitioner on bail, although charge-sheet has been

submitted. As such, the prayer for bail of the petitioner is rejected.

However, it is directed that the learned Trial Court, within a month from the next date, would complete the stage of consideration of charges and thereafter within a period of sixty days, complete the evidence of seizure list witnesses. Petitioner would be at liberty to approach this Court after the evidence of the seizure list witnesses is over. The application for bail, being CRM (NDPS) 442 of 2026, is, thus, disposed of.
