Petitioner is aggrieved by the fact that although police authorities have registered case being Chapra PS Case No. 69/2022 and charge sheet has been submitted by the police authorities, yet there has been interference in respect of the cultivation of the petitioner at the behest of the private respondents. So far as the records of the case are concerned, TS 259/2019 is pending before the learned Civil Judge (Junior Division), 3rd Court, Krishnanagar, Nadia wherein a decree has been passed restraining the defendants from creating any disturbance in respect of the peaceful possession over the scheduled property.

Be that as it may, since the civil court has decreed the order, if the petitioner is so advised

petitioner would approach the civil court for execution of the decree. Any directions passed by the civil court should be respected, obeyed and implemented by the police authorities.

With the aforesaid observations WPA 5092 of 2022 is disposed of.

Report so submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
