This is an application under Article 226 of the Constitution of India wherein the writ petitioners are aggrieved by the impugned 'Acknowledgement for submission of appeal' dated December 29, 2020 issued by the Joint Commissioner on behalf of the appellate authority.

Mr. Arijit Chakrabarti, counsel appearing on behalf of the petitioners submits that since pandemic has now come to an end, he shall be able to obtain certified copy and file the same with the appropriate authority. 3.

Mr.

Majumder, learned Additional Advocate General, appearing on behalf of the State GST does not oppose the said prayer.

I have heard counsel appearing on behalf of the parties and perused the materials on record. Accordingly, I direct the petitioners to file the certified copy with the authorities within a period of fifteen days from date and

upon such filing, the authorities are directed to hear the appeal on merits.

With the above direction, the writ petition is disposed of. There will be no order as to costs. 6.

Since no affidavit-in-opposition is called for, the allegations made in the writ petition are deemed not to have been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
