It is also submitted that out of the 24 witnesses cited by the prosecution, till date, only 13 witnesses have been examined and the evidence of P.W.14 is in progress.

Learned advocate for the State opposes the prayer for bail and submits that there are overwhelming materials appearing against the present petitioner.

I have taken into account the previous orders passed by this court.

Having considered the same and emphasizing that the prosecution should appreciate that Article 21 of the Constitution of India will have an overriding effect, as a

matter of last chance, the prosecution is granted six months' time to complete rest of the witnesses.

The learned trial court would, accordingly, fix a schedule so that the trial is taken to its logical conclusion within the aforesaid period. In case, within the six months from the next date fixed, the trial court is unable to complete rest of the witnesses inspite of all cooperation extended by the petitioner, the learned trial court would, thereafter, release the petitioner on bail.

Considering the overall circumstances, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected.

Accordingly, CRM (M) 636 of 2026 is dismissed. The learned Registrar General, High Court, Calcutta is directed to communicate this court to the learned trial court being the learned Additional Sessions Jude, 1st Fast Track Court, Jangipur, Murshidabad.
