The daughters of late Bhuban Chandra Das Mahapatra allege that the Pradhan of Rishi Bankim Chandra Gram Panchayat, did not process their applications for grant of heirship certificate after demise of their father. According to the petitioners, the heirs and legal representatives of the deceased are as follows :-
1. Surjendu Bikash Das Mahapatra
2. Krishnendu Das Mahaptra
3. Suvendu Das Mahapatra
4. Sobita Rani Das
5. Swagata Das The mother predeceased the father.
It appears that the representations were also filed before the concerned Block Development Officer. The petitioners approached the Pradhan of Rishi Bankim Chandra Gram Panchayat, by a letter dated December 26, 2022.
Under such circumstances, this writ petition is disposed of with a direction upon the Pradhan of the
Rishi Bankim Chandra Gram Panchayat to dispose of the representations of the petitioners for grant of legal heir certificate in accordance with law. It is made clear that the right, title and interest of the parties have not been gone into. The correctness of the contentions of the petitioner has also not been considered.
The panchayat authorities shall make necessary enquiry and take steps to issue the legal heirship certificate strictly in accordance with law and in favour of all the surviving heirs and legal representatives of the deceased Bhuban Chandra Das Mahapatra .
A hearing shall be given to the petitioners as also other heirs of the deceased. Necessary steps shall be given in accordance with law.
The entire exercise shall be completed within a period of six weeks from the date of communication of this order.
A copy of the writ petition along with server copy of this order be supplied to the Rishi Bankim Chandra Gram Panchayat.
This writ petition is disposed of.
There will be, however, no order as to costs. All parties are directed to act on the server copy of this order.
