It appears from the report and is also submitted by the learned counsels appearing on behalf of the parties that the defacto complainant/ opposite party is not willing to proceed with the matter any further in view of the mutual settlement arrived at by and between the parties.

In view of the above, this Court is inclined to hold that allowing the proceeding to continue shall be a futile exercise. The criminal revision being CRR No. 1078 of 2025 is allowed.

The proceeding being G.R.Case No. 4560 of 2021 pending before the learned Judicial Magistrate, 5th Court at Howrah be quashed.

The petitioners be set at liberty at once and discharged from their bail bonds.
