AGP Mr. Balarko Sen ... for the State-respondent(s) The petitioners complain that the private respondents are trying to construct a road for their personal use over a plot of land which belongs to them. When they restricted the private respondents, they were subjected to abuse and humiliation. To that effect, they informed the police station on or about 27th February, 2024, but no steps were taken by the said police station.

State has submitted a report which reflects that the police authorities after having knowledge regarding the same drew up a proceeding under Section 126

of the BNSS.

Having considered that the police authorities are in seisin of the knowledge and the dispute relating to construction of the road, as claimed by the petitioner, do not fall within the ambit of the jurisdiction of the police authorities, I am of the view that the petitioners should approach the jurisdictional civil court for appropriate remedies if till date the same problem continues.

So far as the issue relating to abuse and humiliation is concerned, the police authorities would continue their surveillance and ensure that no breach of the peace and/or tranquility takes place as also no untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations, WPA 5630 of 2024 is disposed of.
