Heard learned counsels for the parties.

The petitioners are the brothers in law of the deceased who was married to the principal accused before about 30 years.

The petitioners are in custody for about 126 days and pray for bail.

Learned counsel for the State opposes the prayer. It appears that the victim was allegedly murdered by her husband, who is the principal accused. These petitioners are the brothers in law. The sons of the victim who appear to be the eyewitness of the incident have neither been examined in course of investigation, nor have been cited as witnesses in the charge sheet.

Considering the material on record as well as extent of complicity of the petitioners in the alleged offence, prayer for bail is allowed.

The petitioners Sadagar Dom & Radha Dom @ Raddhai Dom be released on bail upon furnishing bond of Rs.10,000/- each (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judicial Magistrate, Dubrajpur, Birbhum subject to condition that they appear before the learned trial Court on every date of hearing. They shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event the petitioners fail to appear before the learned trial Court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel their bail in accordance with law without further reference to this Court. The application for bail is thus disposed of. Case Diary be returned.
