Mr. Supratick Shyamal, Mr. Anirban Tribedi ...for the petitioners A direction to secure expeditious disposal of an interlocutory application praying for fixation of fare rent, now pending before the learned Additional Rent Controller at Alipore, in connection with ARC Case No.06[17(4B)] of 2017, is the ultimate relief, sought for in this revisional application.

The only contention expressed by the learned advocate for the petitioners is that the prayer for fixation of fare rent has been kept pending since long and the same needs to be disposed of expeditiously as possible.

In view of the nature of the order proposed to be made, prior notice upon the opposite parties is considered not necessary. Service upon the opposite parties is thus dispensed with.

Accordingly, learned Additional Rent Controller at Alipore in connection with ARC Case No.06 [17(4B)] of 2017 is requested to ensure expeditious disposal of the

pending interlocutory application providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable. While endeavouring such exercise, learned Additional Rent Controller at Alipore may proceed to dispose of the interlocutory application in the manner, as situation of the case would demand, so as to dispense with the justice in a best possible manner. With this direction/observation the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
