Petitioner is aggrieved by the fact that inspite of 25.02.2025 Court No. 35 Item No.14 Rakib directions passed in T.S. 258 of 2019, wherein the learned Magistrate was pleased to pass order of status quo in respect of nature, character and possession of the property, the private respondents have been pursuing their illegal objective, thereby attempting to dispossess the petitioner as well as disturbed him while the process of cultivation was continuing.

To that effect information was furnished to the Officer-in-Charge Namkhana Police Station on or about 24.02.2023 and the police authorities inspite of receipt of such information did not take any steps.

Learned advocate for the State is present and submits that the police authorities have always acted in accordance with law and as and when so informed took appropriate steps. As such till date there is no allegation that the petitioner has either been dispossessed or has been restrained from cultivating his own land.

I have considered the submissions of the petitioner which reflects that the information which was furnished to the police authorities were that the petitioner was apprehending dispossession as well as being restrained from cultivating his own land. In case such a situation arises the police authorities will render assistance by respecting order passed by the learned Civil Court. With the aforesaid observations, WPA 5406 of 2023 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
