Mr. Laxminath Bhattacharya Ms. Mousumi Ranjan Das ..for the petitioners Mr. Swapan Banerjee Mr. Diptendu Narayan Banerjee ..for the State The petitioners were daily rated workmen engaged by the respondent no.6. The petitioners have not been paid wages/salary for a long period of time and as such they have approached this Court with a prayer to consider their representation dated 6th February, 2023. The petitioners say that they will be satisfied if the representation dated 6th February, 2023 is considered by the concerned authority in right earnestness. In the aforesaid facts and circumstances, the District Magistrate, South 24 Parganas is directed to dispose of the petitioners' representation dated 6th February, 2023 which appears at pages 13 to 15 of the writ petition by a reasoned order after affording the

petitioners an opportunity of hearing within a period of eight months from the date of service of a server copy of this order along with a copy of this writ petition. The parties should act on a server copy of this order without insisting upon production of a certified copy thereof.

It is made clear that this Court has not gone into the merits of the matter and the learned District Magistrate shall be free to adjudicate all the issues that may arise without being influenced in any manner by any observation made in this order.

The writ petition is accordingly disposed of. Since I have not called for affidavit, the allegations contained in the writ petition are deemed to have not been admitted by the respondents.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
