The report is enclosed with number of documents including that of the Electoral Registration Officer, 151- Belapur Assembly Constituency. The report of the Electoral Registration Officer questions the genuinity of the EPIC Card which was submitted.

Having regard to the facts, I am of the view that the petitioner is not entitled to be released on bail.

Accordingly, C.R.M.(SB) 45 of 2023 is dismissed. Learned advocate appearing for the State is directed to instruct the Officer-in-Charge, Swarupnagar Police Station and/or the Investigating Officer of the case to submit the same report with the learned A.C.J.M., Basirhat. The report would be tagged alongwith the records of Swarupnagar Police Station Case No.244/2022 dated 17.03.2022. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
