Bihani Mr. Abhishek Sikdar ..for the KMC Mr. Suddhadev Adak ..for the State Mr. Tanish Ganeriwala ..for the respdts.9-12 The Kolkata Municipal Corporation has submitted a report pursuant to the earlier direction of this Court dated March 25, 2022. It appears that an enquiry was made of the premises nos. 69A,B,& C and 71A&B, Rashbehari Avenue, Kolkata 700 026 by the license Inspector. It was found that the passage had been left vacant and no exhibition was held. The concerned respondent no.12 had filed an undertaking stating that no exhibition would be organized on 26th and 27th March, 2022. Accordingly, nothing survives to be decided in this writ petition further.
The learned advocate for the respondent nos. 9 to 12 submits that if in future, the occasion so
arises, and exhibitions are held by the respondent nos. 9 to12, then the said respondents shall proceed in accordance with law upon obtaining necessary permission from all the required authorities, for holding such exhibition.
The Fire Brigade has also filed a report, from which it appears that for erection of any temporary structure, permission was required from the fire department. Let the said report be taken on record. As nothing further remains to be decided in this writ petition, the writ petition is disposed of. A copy of the undertaking of Mr. Rohan Sur, submitted before the department of License, Kolkata Municipal Corporation, is also on record.
Under such circumstances, this writ petition is disposed of with a direction that if in future such exhibition is planned and held, the same shall be done in accordance with law and upon all necessary compliances.
This writ petition is disposed of.
There will be, however, no order as to costs. All parties are directed to act on the server copy of this order.
