Petitioners approached this court immediately after submission of charge-sheet. None of the documents under Section 207 of the Code of Criminal Procedure have been enclosed along with the revisional application.

Having regard to the stage at which the petitioners approached this court, I am of the view the same is premature.

Accordingly, the petitioners would be at liberty to take out an appropriate application under Section 239 of the Code of Criminal Procedure at the stage of consideration of charges, the learned Magistrate would dispose of the same in accordance with law.

Needless to state that independently the learned Magistrate will arrive its finding without being influenced by any observation made by this court. With the aforesaid observations, CRR 936 of 2022 is disposed of.

All the parties shall act on the server copy of this order duly downloaded from the official website of this court.
