Allowed C.R.M.(A) 859 of 2025 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Santipur Police Station Case No. 1638 of 2024 dated 29.12.2024 under Sections 108/3(5) of the Bharatiya Nyaya Sanhita, 2023 pending before the learned Chief Judicial Magistrate, Ranaghat, Nadia.

And In Re : Kalam Mondal @ Abul Kalam Mondal & Anr. ...... petitioners Ms. Puja Goswami ...for the petitioners Mr. Rana Mukherjee Ms. Rituparna Saha ...for the State Principal accused is on bail.

Application is not pressed so far as the petitioner no. 1 is concerned as he was arrested C.R.M. (A) 859 of 2025 is dismissed as not pressed in respect of petitioner no. 1.

Police is investigating a case of abetment to commit suicide.

The issue as to whether petitioner no. 2 before us abeted the suicide committed, may be decided at the trial. Materials as against the petitioner no. 2 do not suggest requirement of custody of the petitioner no. 2.

In such circumstances, we grant anticipatory bail to the petitioner no. 2, namely Kharija Bibi.

Accordingly, we direct that in the event of arrest, the petitioner no. 2, namely Kharija Bibi shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482 (2) of the B.N.S.S., 2023. The petitioner no. 2 shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioners in Court including cancelling the anticipatory bail granted without further reference to this Court.

This application for anticipatory bail in respect of the petitioner no. 2 is, thus, allowed.
