This revisional application under Section 482 of the Code of Criminal Procedure is listed today for hearing. The petitioners preferred this revisional application praying for quashing of G.R. Case No.841 of 2011 arising out of Bidhannagar (South) P. S. Case No.211 of 2011 under Section 498A/ 406/ 34 of the Indian Penal Code.

Learned advocate for the petitioners submits that during pendency of the application Francis Chatterjee/petitioner no.1 has expired and the matter relates to an alleged second marriage of the deceased petitioner with opposite party no.1. It is further submitted that the petitioners are not inclined to proceed with the revisional application before this Court and the same may be

disposed of with a direction to the Learned Trial Court to expedite the trial of the case.

Learned advocate for the opposite party no.1 raised no objection. It is gather from a copy of an order dated 09.01.2013 passed by the Learned Additional District Judge, Alipore, 7th Court in M.A.T. Suit No.59 of 2012 that the marriage solemnized between the deceased petitioner no.1 and Anandi Chatterjee, the present respondent no.1 has been dissolved. Under such circumstances, the revisional application is disposed of. Interim order, if any, stands vacated.

Let a copy of this order be sent to Learned Additional Chief Judicial Magistrate, Bidhannagar, North 24 Parganas with a direction to expedite the trial of G.R. Case No.841 of 2011 and dispose of the same preferably within a period of six months from the date of communication of this order. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Ananda Kumar Mukherjee, J.)
