Petitioner is aggrieved by the fact that in spite of 28.08.2025 Court No. 35 M/L. No.436 Rakib sending information, no steps have been taken by the police authorities. Petitioner's anxiety is that he may be thrown out of the property, although, he is in possession of such property.

On the other hand learned advocate for the private respondents submit that there are no civil suit pending and the petitioner is forcing his right over the property. State has submitted a report. Report of the State reflects that a tenancy dispute is existing between number of tenants. To that effect earlier a case being Shibpur Police Station case no. 321/23 dated 05.09.2023 was registered for investigation. On conclusion of investigation charge-sheet was submitted in connection with the said case. Another case being Shibpur Police Station case no. 322/23 dated 05.09.2023 was registered for investigation. FIR named accused was arrested and the investigating agency on conclusion of investigation

also submitted a charge-sheet before the jurisdictional Court.

Having considered that police authorities are well aware regarding the nature of the dispute, I am of the view that the police authorities would oversee that there is no violation of law and order.

With the aforesaid observations WPA 5590 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
