For the State The grievance of the petitioner is directed against the alleged non-payment of provident fund dues as also interest on gratuity payable to the petitioner. It is further submitted that the petitioner is a retired headmaster and is also a senior citizen.

Ms. Chaitali Bhattacharyya, learned counsel appearing on behalf of the State submits that the matter can be appropriately dealt with by directing the Secretary, Department of the School Education being respondent No. 2 to consider the case of the petitioner as to whether he is entitled to any amount on account of provident fund dues or on account of interest on gratuity. It is further submitted by her that there appears to be some foul pay in the claim of the petitioner.

I have heard the parties. I have also perused the pleadings. I am of the view that the respondent No. 2 be directed to consider and dispose of the claim of the petitioner on account of provident fund dues as also on account of interest on gratuity. Since the petitioner is a senior citizen, the respondent No. 2 is directed to expeditiously consider the claim of the petitioner within a period of four weeks from the date of communication of this order.

I make it clear that I have not gone into the merits of the case and the respondent No. 2 will not be influenced by any observation made in this order on the merits of the case.

With the aforesaid directions, W.P.A. 4016 of 2015 is disposed of.

There shall be no order as to costs.

Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
