This revisional application was filed assailing the order dated 21.8.2012 passed by the learned Judicial Magistrate, 2nd Court, Suri Birbhum convicting the petitioner under Section 138 of the Negotiable Instruments Act and sentencing him to fine of Rs.1,52,000/- only in default to suffer simple imprisonment for ten months in connection with C. case No.575 of 2009. By order dated 8.2.2022 a direction was given to the Registrar (L&OM) for issuing notice upon the petitioner directing him to show cause on 28.2.2022 as to why the application shall not be dismissed for default for his non-appearance before this court. Administrative report has been received. It appears therefrom that the petitioner Bhagyadhar Saha has expired and the notice could not be served upon him. Let the report be taken on record. The revisional application is therefore, abates due to death of the petitioner and the same is disposed of.
