Certified copy, as directed earlier by this Court, filed on behalf of the petitioner be kept with the record. The petitioner has approached this Court for expediting the revisional application which is pending before learned ADJ, 4th Fast Track Court, Alipore being Criminal Motion No. 327 of 2023. The subject-matter of the case relates to a proceeding under Section 125 of the Code of Criminal Procedure.

As the revisional application is pending, I do not intend to interfere with the merits of the case. However, I direct that as the next date is fixed on 20.03.2024, the learned revisional court being the learned ADJ, 4th Fast Track Court, Alipore would dispose of the revisional application by 20.06.2024. In case there is any procedure adopted which contributes delay at the instance of the petitioner, the learned trial court will be at liberty to vacate the interim order and revive the order passed by the learned Judicial Magistrate in case No. ACM 859 of 2021.

The learned revisional court is directed that in case there is any resolution of the local Bar, the hearing of the proceedings will not be stalled and the learned court will be

at liberty to fix as many dates as it deems fit and proper, but will not stretch the time line as fixed by this Court. With the aforesaid observations, the revisional application being CRR 877 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
