The revisional application was preferred at the instance of the accused petitioner praying for quashing of the FIR and subsequent proceedings arising out of the Bidhannagar (East) P.S. Case No. 12 dated 26.01.2011.

Mr. Suman De, learned advocate has submitted a subsequent report dated 20.8.2021 by the Inspector-in-Charge, Bidhannagar Police Commissionerate, which reflects the observation made by the learned Additional Chief Judicial Magistrate, Bidhannagar, North 24 Parganas on 15.09.2015. The observation was made is as follows:

"Accordingly at this stage I find no other alternative than to discharge the accused person from this case after accepting the FRT with liberty upon the prosecution to reopen the matter in future if so requires."

Report so submitted be kept with the record.

The revisional application, as such, is without any merit and accordingly CRR 683 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of. Interim order, if any, is hereby vacated. (Tirthankar Ghosh, J.)
