IN THE HIGH COURT AT CALCUTTA

Item No.3 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 688 of 2012 (Via Video Conference) Satya Narayan Gupta & Ors.

versus The State of West Bengal & Anr.

In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973.

Mr. Debangan Bhattacharjee, Ms. Swarnali Dipti Saha ... For the Petitioners.

Mr. Arijit Ganguly, Mr. Sanjib Kumar Dan ... For the State.

Mr. Arijit Ganguly, learned advocate appearing for the State has submitted a report of Officer-in-Charge, Ultadanga Police Station. The said report dated 16.09.2021 be kept with the record.

Report reflects that two of the petitioners viz., Satya Narayan Gupta and Durga Prasad Shaw have expired and accordingly, death certificates have been enclosed along with the report.

So far as the other petitioner is concerned viz., Jai Kishore Agarwal, there is no reference regarding him in the report submitted by the Officer-in-Charge, Ultadanga Police Station.

Having regard to the present state of affairs and the fact that the revisional application is pending for more than nine years, I am of the view that further pendency of this

revisional application is unwarranted in view of the present set of circumstances.

The learned jurisdictional court is directed to conduct an enquiry regarding the availability of the three petitioners, viz., Satya Narayan Gupta, Durga Prosad Shaw and Jai Kishore Agarwal and thereafter proceed in accordance with law.

With the aforesaid observations, the revisional application being CRR 688 of 2012 is disposed of. Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
