Md. Anwar Hossain Ms. Sreyashee Biswas .... For the State This is an application seeking expeditious disposal of a proceeding in which charge sheet was submitted under Sections 21 (C) of the N.D.P.S. Act.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. He is in custody since his date of arrest i.e. 28.09.2019. On 23.11.2019 a charge sheet was submitted, citing eight prosecution witnesses. 09.04.2021 has been fixed as next date for consideration of charge. The impugned proceeding has been pending for no fault on the part of the petitioner. Learned counsel appearing on behalf of the State submits that the impugned proceeding ought to be expedited considering the fact that petitioner is in custody since his date of arrest. I have heard the submissions of the learned counsels appearing on behalf of the petitioner and have perused the revision petition.

It appears that some delay was occasioned in concluding the present proceeding, especially considering the fact that the petitioner is in custody since 28.09.2019.

In view of the above, and in the interest of justice, I request the learned Trial Court to conclude the proceeding as expeditiously as

possible without granting any unnecessary adjournment to any of the parties and in particular, to decide the question of framing of charges on next date fixed for hearing or within fortnight from the said date. With these observations, the revision petition is disposed of. Urgent photostat certified copy of this order, if applied for, is to be given to the parties upon usual undertakings. (Jay Sengupta, J.)
