This is a contempt proceeding arising from an order dated March 18, 2025 passed by this Court. Pursuant to the said order the jurisdictional Executive Engineer, PWD (Roads) has passed its reasoned order dated April 23, 2025, annexure A-3 at page 23 to the contempt application. The reasoned order suggests that, pursuant to the purchase policy of the State, the case of the petitioner is under active consideration for direct purchase of the land as the land has been already utilized by the State authority without any acquisition.

Ms. Tuli Sinha, learned advocate appearing for the alleged contemnors files a report, which suggests that for the entire chunk of land the compensation/the purchase value to be paid to the

land owners, whose land has been utilized without acquisition have been determined. Out of the said chunk of land the petitioner is the owner of a portion thereof. Accordingly, the amount to be paid to the petitioner considering his portion of land is now also under consideration after being proper apportionment being done. The report is taken on record. Copy has been served upon the learned advocate appearing for the petitioner in Court today.

In view of the above, the alleged contemnor no. 2 shall file an affidavit showing compliance of the direction of this Court to the extent by determining the apportionment for petitioner's portion of the land out of the said chunk of land and the quantum of sum shall be specifically ascertained and stated in the affidavit.

Such an affidavit shall be filed by the alleged contemnor no. 2 on or before February 16, 2026 upon a copy being furnished to the learned advocate on record for the petitioner.

The matter shall appear under the heading "Contempt Application" on March 13, 2026.
