W.P.A. 4309 of 2019 (Sannyasi Samanta & Ors. vs. State & Ors.) Mr. Barun Kr. Samanta ....For the Petitioners Mr. Jahar Lal De .... For the State The grievance of the petitioners is directed against the unlawful and illegal acquisition of their land by the State respondents.

Mr. De appearing on behalf of the State respondents submits that the land of the petitioners has not been acquired. However, Mr. De submits that the representation of the petitioners appearing at page 19 of the petition may be considered by the Sub-Divisional Officer (Irrigation), Ghatal Irrigation Sub-Division, Ghatal being the respondent No. 4 herein.

In view of the submissions made by the State respondents, the respondent No. 4 is directed to consider the representation of the petitioner (appearing at page 19 of the writ petition) in accordance with law within a period of six weeks from the date of communication of this order after giving a right of hearing to the petitioners and the State respondents. The respondent No. 4 is also requested to communicate the final decision to the petitioners within a period of two weeks from the date of taking such decision. I make it clear that I have not gone into the merits of

the case and the respondent No. 4 will not be bound or influenced by anything in this order on the merits of the case. With the aforesaid directions, W.P.A. 4309 of 2019 is disposed of.

However, there shall be no order as to costs. (Ravi Krishan Kapur, J.)
