This is an application for expeditious disposal of N. Case No.107 of 2021 arising out of Matia Police Station Case No.351 dated 22nd August, 2021 under Section 21 (c) of the Narcotic Drugs and

Psychotropic Substances Act now pending before the 6th Court of the learned Additional Sessions Judge, North 24 Parganas at Barasat. On the last occasion the Investigating Officer submitted a report stating, inter alia, that on receipt of chemical examination report Investigating Officer submitted supplementary charge sheet in connection with the above case only on 19th July, 2022. It is not stated as to whether charge has been framed against the accused or not.

It is needless to say that trial commences on framing of charge. If charge is not framed, any direction to the learned trial Judge for expeditious trial will be superfluous.

Therefore, the instant criminal revision is disposed of directing the trial Court to frame charge against the accused on a date in the month of August, 2022 and thereafter fix a schedule for examination of the witnesses in accordance with the provision under Section 309 of the Code of Criminal Procedure.

The learned trial Judge is also requested to take a proactive step so that witnesses on behalf of the prosecution may be produced for examination on the date of trial.

The instant revision is, thus, disposed of.
