Learned advocate for Jangipur Municipality submits that he has filed Vakalatnama in the department vide filing No. A-11735 dated 30.06.2022. The department is directed to tag the same with the records.
Leave is granted to the learned advocate of the petitioner to implead the Chairman, Jangipur Municipality as party respondent in the instant writ application. The formality of serving a copy of the writ petition upon the Chairman, Jangipur Municipality stands dispensed with as learned advocate has already entered appearance on behalf of the Jangipur Municipality.
The petitioner was engaged as casual worker in the post of Work Supervisor under the Jangipur Municipality on 12.08.1996. He is serving the Jangipur Municipality till date.
The petitioner prays for the service benefits in terms of the Government Memorandum No. 3998-F(P-2) dated 15.07.2019 issued by the Finance Department, Audit Branch.
The petitioner made a representation before the Jangipur Municipality on 07.12.2020 and alleges that the said representation has not been taken up for consideration till date.
Learned advocate for the Jangipur Municipality seeks time to consider the representation filed by the petitioner.
In view of the above, the instant writ petition is disposed of by directing the Chairman, Jangipur Municipality to consider the representation filed by the petitioner in the light of the Government Memorandum mentioned hereinabove at the earliest, but positively within a period of eight weeks from the date of communication of this order.
The petitioner is directed to forward a copy of the representation dated 07.12.2020 along with the Government Memorandum dated 15.07.2019 and all other documents in support of his claim to the Chairman of the Municipality at the time of communicating the order of this Court.
The aforesaid respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.
Writ petition is disposed of.
There shall be, however, no order as to costs. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
