Learned advocate appearing for the petitioner has submitted a representation before the Commissioner of Police, Barrackpore as also the Officer-in-charge, Baranagar Police Station wherein he has claimed that he intends to raise a construction in his share of land which is being interfered with by the private respondents.

Learned advocate for the private respondents on the other hand submits that the petitioner is trying to use the construction by blocking the common pathway.

Learned advocate for the State submits that in respect of construction, police has got no role to

play until and unless directed by an appropriate court of law.

Petitioner would if he claims to have any right to construct any property over the land concern, approach the jurisdictional court for appropriate remedy.

So far as police authorities are concerned, they are not entitled to extend any relief in such circumstances.

With the aforesaid observations WPA 5392 of 2025 is disposed of.
