Report along with judgment dated 24.6.2019 passed by the learned Additional Chief Judicial Magistrate, Sealdah 24 Parganas (South ) submitted by the State is taken on record.

Upon perusal of the report, it appears the proceeding arising out of GR Case No.

3314/2015 corresponding to charge sheet No.

277/2017 dated 30.11.2015 under Section 341/323/114 of the Indian Penal Code , 1860 in connection with Chitpur P.S. Case No. 322 of 2015 dated 11.10.2015 under Sections 341/323/114 of the Indian Penal Code was pending before the learned Additional Chief Judicial Magistrate, Sealdah, 24 Parganas (South) and the same was subsequently registered as Trial No. 17/2018.

The said trial was finally concluded and after conclusion of the said trial the learned Court below acquitted the persons, namely, Bapi Achariya, Biltu Mondal, Purnima Mondal and Laltu Mondal under Section 255 (1) of

the Criminal Procedure Code. In the present case two accused persons, namely, Purnima Mondal and Biltu Mondal filed this application under Section 401 read with Section 482 of the Code of Criminal Procedure , 1973 seeking quashing of the aforesaid proceeding.

However, they have already been acquitted from the said proceedings vide judgment dated24.6.2019.

Under such circumstances, the instant revisional application become infructuous.

Accordingly, CRR 631 of 2018 is, thus, dismissed being infructuous.

Let a copy of this order be communicated to the learned Court below for information.

Urgent xerox certified copy of this order, if applied for, be given to the learned advocate for the parties.
