The petitioner is a lady who is suffering seriously from Chronic Obstructive Pulmonary Disorder. She has been absenting from the school for last three years due to her ailment. She prays before this court either for a transfer to a nearby school and if not possible, premature retirement from her service with all retiral dues to which she is entitled to.

I direct the Commissioner of School Education to consider the matter sympathically within a period of eight weeks from the date of communication of this order after hearing the petitioner and the petitioner shall have liberty to be represented through his learned advocate. The Commissioner shall also hear the school

where she is working now as well as the concerned DPSC on the date when the petitioner will be heard. The hearing may take place for more than one day, but shall not be more than three days. The order has to be passed by two weeks from the last date of hearing. With the above observation and direction, this writ application is disposed of.
