Learned advocate appearing for the petitioner submits that, the petitioner was falsely implicated. No arms was recovered from the possession of the petitioner. Learned advocate appearing for the State submits that, two motor cycles were intercepted in one of which the petitioner was a pillion rider. In fact, the pillion riders of the two motor cycles fled away from the spot, which includes the petitioner. So far as the petitioner is concerned, there is another police complaint against the petitioner with regard to a dacoity at the adjoining police station on the same day.
In answer to query of the Court, learned advocate appearing for the State submits that, the police filed chargesheet. Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the case diary and considering the fact that there is a police
complaint against the petitioner in respect of a dacoity case in another police station on the same day, we are unable to enlarge the petitioner on anticipatory bail.
Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1385 of 2022 is dismissed.
