Mr. Suranjan Mondal Mr. Satyajit Mondal ..for the petitioner This revisional application has been directed against an order dated January 27, 2021 passed by the learned Civil Judge, Senior Division, Diamond Harbour, District Sough 24 Parganas in Title Suit No. 226 of 2019. The petitioner is aggrieved because the learned Court below rejected the prayer for repair on the ground that the petitioner failed to show any single document in support of his contentions that a portion of the mud house and thatched roof in which the petitioner was staying was dilapidated and was in need of immediate repair. The petitioner also failed to show that the repair would be done from the money received under Bengal Abas Yojona Scheme as alleged. As the petitioner failed to produce any document in support of his contentions, the learned Court below upon finding of such facts to be mere submissions without any documents in support thereof, rejected the said application.

I do not find any reason to interfere with the order impugned.

This revisional application is dismissed.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
