Learned advocate for the petitioner is aggrieved by the fact that Tarakeswar P.S. Case No.30 of dated 20.01.2024 was registered for investigation under Sections 341/323/354/504 of the Indian Penal Code as well as under the relevant provisions of SC & ST Prevention of Atrocities Act, 1989, but no information has been sent to the de facto complainant and she is unaware regarding the outcome of the investigation.

As none appears on behalf of the State, Mr.

Bipin Ghosh, learned advocate, who ordinarily appears on behalf of the State, is directed to represent

the State. His appearance may be regularized by the concerned authorities.

Since the investigation commenced under a Special Act and superior officer of police was supposed to progress with the investigation of the case and almost 11⁄2 years have passed since the investigation commenced, I direct that in case the petitioner takes out any application before the learned special court, learned special court would ensure that the petitioner's grievance in relation to investigation, charge-sheet and/or any inaction on the police authorities are addressed in its proper perspective. If the petitioner apprehends that she may be subjected to inconveniences, threat, coercion at the behest of the private respondents or the accused persons, necessary directions be passed by the learned special court under the relevant provisions of the Witness Protection Scheme, 2018 provided the case referred to is still pending.

With the aforesaid observations, WPA 5669 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
