Learned advocate representing the Corporation produces the instruction signed by the Assistant Engineer (C) and Executive Engineer(C), Building Department, Borough-III, Kolkata Municipal Corporation on July 27, 2023 mentioning that none of the parties were present at the spot for conducting spot inspection on the date and time fixed by the Court. The premises was under lock and key and, accordingly, inspection could not be carried out. The Kolkata Municipal Corporation officials waited from 1 p.m. to 1.30 p.m., thereafter left the premises.

It appears from the conduct of the petitioner that he is not interested to proceed with the writ petition.

Accordingly, the writ petition stands dismissed. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. Sh. (Amrita Sinha, J.)
