Mr. Arnab Roy, Mr. Soumayadeep Mukherjee. ... for the petitioner. This revisional application has been filed with a prayer for expeditious disposal of Title Suit No. 107 of 2009 pending before the learned Civil Judge (Senior Division), Asansol.

Certified copy of the order annexed herewith, I find that learned Commissioner did not submit the report before the Trial Court.

Learned advocate appearing on behalf of the petitioner has submitted that learned Commissioner visited the subject property but did not file the report before the Trial Court in spite of having several adjournments.

Considering the nature of the prayer, I do not find any reason to ask the learned advocate on behalf of the petitioner to serve notice upon the opposite parties.

Service upon the opposite parties is thus dispensed with.

The learned Civil Judge (Senior Division), Asansol is requested to ensure submission of the report by the learned advocate Commissioner before him within one month from the date of this order. Learned Judge is also requested to dispose of the of Title Suit No. 107 of 2009 as expeditiously as possible without giving any unnecessary adjournment to any of the parties save and except extreme urgency.

Petitioner is directed to make communication of this order to the learned Civil Judge (Senior Division), Asansol.

With this observation and direction, the revisional application stands disposed of.

All the parties shall act on the server copy of this order duly downloaded from the official web site of this Court.
