Petitioner is directed to serve a copy of the revisional application upon Mr. Pravas Bhattacharya, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner submits that because of non-appearance and/or absconsion of some of the accused persons the petitioner is suffering as till date the copies have not been supplied, although the case was initiated in the year 2015.

I find substantial force in the submission of the learned advocate appearing for the petitioner.

Accordingly, I direct the learned ACJM, Gangarampur at Buniadpur, Dakshin Dinajpur to exhaust all process of law so far as compelling the appearance of the accused persons are concerned. If the absconding accused persons are still not available before the court, in that case, the learned trial court would declare them as

proclaimed offenders and segregate their case. Learned trial court would thereafter supply copies under Section 207 of the Code of Criminal Procedure to the petitioner and the other accused persons who are present in court so that further process and progress of the criminal case may be effected in connection with Harirampur Police Station Case No.84 of 2015 dated 23.05.2015.

With the aforesaid observations, CRR 828 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
