Being aggrieved by the rejection of the prayer for discharge before the Juvenile Justice Board, the petitioner has come before this court in connection with Salanpur P.S. Case No.152 of 2014 dated 12.08.2014 under Sections 326/307 of the Indian Penal Code.

Pursuant to the leave granted by this Court a supplementary affidavit enclosing all the documents under

Section 207 of the Code of Criminal Procedure has been filed.

I have perused the statement of the witnesses, particularly, the letter of complaint and the statement of Dr. Manas Kr. Banerjee, and after factual appreciation of the same, I am of the view that it would not be fit and proper to interfere at this stage regarding the contentions raised in the discharge petition before the Juvenile Justice Board. The petitioner is granted liberty to agitate all the points canvassed in this revisional application at the appropriate stage or during the trial of the case.

It has been brought to the notice of this court by the learned advocate for the opposite party No.2 the order passed in CRR 1628 of 2019. In view of the case being delayed for various reasons, I direct that the learned Trial Court would take steps so that the aforesaid order of expeditious hearing may be implemented in its true and proper spirit.

With the aforesaid observations, the revisional application being CRR 844 of 2020 is disposed of. Urgent certified copy of this order be immediately made available to the parties subject to compliance with all requisite formalities.
