Mr. Hamidur Rahaman Mr. Parvej Islam ..for the petitioners Mr. Sarvesh Chandra Sirvastav Mr. Janardan Mondal ..for the State Affidavit of service filed in Court today is taken on record.

The petitioners claim to be the owner of Plot No. 5 within Mouza Godhonpara, J.L. No.81 under Raninagar II Block under Police Station Raninagar in the District of Murshidabad. The petitioners state that the plot belonging to the Public Works Department is lying adjacent to the aforesaid property of the petitioners. The petitioners state that since the PWD land is a low land the petitioners are finding in difficult to get an access to the main road from their property through the PWD land.

The learned advocate appearing for the petitioners submits that a representation has been submitted before the various authorities including the Sub-Divisional Officer, Domkal, Murshidabad for upgradation of the said PWD road. He submits that no decision on such

representation has been communicated to the petitioners till date.

The learned advocate appearing for the State submits that the decision on such representation shall be communicated to the petitioners within the time limit as may be fixed by this Court.

In the light of the submissions made by the learned advocates for the respective parties and without entering into the merits of the claim made by the petitioners in the representation dated 22nd February, 2026, WPA 5667 of 2026 stands disposed of by directing the Sub-Divisional Officer, Domkal, Murshidabad to consider the representation of the petitioners dated 22nd February, 2026 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioners and any other person who may be affected by such decision as well as any other authorities or their authorised representatives and communicate the reasoned order to the petitioners and others as expeditiously as possible but positively within a period of twelve weeks from the receipt of a server copy of this order along with a copy of the representation dated 22nd February, 2026.

The report filed by S.I. of Police, Raninagar Police Station is taken on record.

There shall be however no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
