Though he retired from the said post on August 31, 2023, he was not paid his retiral dues. Attention of this court has been drawn by the learned advocate appearing for the petitioner to Memo No.3606/Gen-PPR dated November 25, 2022, whereby the Chairperson, Board of Administrators, Hooghly-Chinsurah Municipality communicated the Director of Local Bodies, West Bengal, inter alia, as follows :

"Due to mismatch of designation of the above stated employees, this office is not in a position to include the name of the 148 Nos employees of this office in the I.O.S.M.S. portal and very recently the Director of Pension, P.F. & G.I. demand post facto by name approval in favour of the employees whose

pension file has already been placed before the O/o the Director of Pension, P.F. & G.I. for final sanction of pension."

It has been submitted by the learned advocate appearing for the State that the prayer for redesignation of the petitioner as 'Conservancy Worker' has been approved by the Director of Local Bodies by an order dated June 21, 2024, and the Municipality has been directed to release the retiral dues of the petitioner including pension.

In view of the aforesaid stands of the State, I do not see any justification to keep this writ petition pending.

Accordingly, I dispose of this writ petition with a direction upon the Chairman, Hooghly-Chinsurah Municipality to release the retiral dues of the petitioner including pension in terms of the letter dated June 21, 2024, issued by the Director of Local Bodies within a period of two months from the date of communication of this order.

The Director of Local Bodies is personally present before this Court. In view of this order, his personal presence is no more required.

Accordingly, WPA 5684 of 2024 is disposed of. (Kausik Chanda, J.)
