05.03.2024 sdas rejected C.R.M.(DB) No. 697 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Eco Park Police Station Case No. 222 of 2020 dated 05.12.2020 under Sections 376D/342/506 of the Indian Penal Code read with Section 6 of the POCSO Act.

And In Re : Sirajul Biswas .... petitioner Mr. Angshuman Chakraborty ....for the petitioner Mr. Anand Keshari .... for the State 1.

Learned Counsel for the petitioner submits he is in custody for more than three years. There is slow progress in trial. He prays for bail.

Learned Counsel for the State opposes the bail prayer and submits trial has considerably progressed. Only four witnesses are yet to be examined.

We have considered the materials on record.

Allegations involve gang rape of a minor. Trial has considerably progressed. Offence, if proved, would attract minimum imprisonment for twenty years. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.

4. Application for bail is, thus, rejected.
