Report submitted by the State reflects that no complaint has been received from any corner regarding intimidation to the witnesses or tampering of the evidence, the petitioner has been appearing in the Trial Court on every date. However, there is a confusion in respect of the information relating to the address of the petitioner where he had been staying not being informed to the Investigating Officer of the case.
I find that the report has been prepared by Kazi Rafikul Islam, Sub-Inspector of Police, Detective Department,
Bidhannagar Police Commissionerate while the Investigating Officer of the case happens to be LSI, Susmita Kanjilal. Enclosures to the supplementary affidavit filed by the petitioner reflects that information was furnished to the principal Investigating Officer by way of electronic mode. Learned advocate for the defacto complainant submits that the victim in this case was threatened and the same was brought to the notice of the Court. In case such inconveniences are faced by the victim, the police authorities would take appropriate steps in accordance with law.
Be that as it may, status of the case reflects that examination of the second Investigation Officer is in progress as the cross-examination of the said witness has been fixed by the learned Trial Court.
The earlier condition imposed is modified to the extent that the petitioner would, once in a month, make himself available to the learned Trial Court irrespective of whether date has been fixed for the case or not. The Office of the Learned Trial Court being the learned Additional Sessions Judge, 1st Court, Barasat will provide an acknowledgement to the petitioner regarding his attendance once in a month. In case there is violation of the condition, the learned Trial Court would cancel the bond furnished in connection with the instant case.
So far as the other conditions are concerned, the same are waived.
Accordingly, CRAN 1 of 2025 is disposed of.
