AGP Mr. Biman Halder ...for the State The petitioner's case is that she wants family pension after the death of her father and then her mother, but it has been refused by the District Inspector of Schools (P.E.) on 05.09.2022 and 21.09.2022. There is no reason disclosed why the petitioner will not get the family pension. Therefore, these two communications which are Annexures P/4 and P/5 are set aside and quashed.

I direct the District Inspector of Schools to give an opportunity of hearing to the petitioner when she will have the liberty to be represented by her learned advocate. Such opportunity of hearing is to be given by four weeks from date and decision after the hearing is to be taken which should be published by one week thereafter and the decision must be one reasoned and speaking one.

The petitioner is granted liberty to place the judgement of this court for consideration of the

District Inspector of Schools on the date of hearing. The order of the said District Inspector of Schools is to be communicated to the petitioner by one week from the date of publication of the said order.

With the above observation and direction, this writ application is disposed of.
