On the perusal of the record it is noticed that the petitioners have prayed for a direction to the concerned respondent to refund the sum of Rs. 70.11 lacs paid by the actor Mithun Chakraborty with the further prayer that the said amount should be refunded to the petitioners.

It is alleged in the petition that actor Mithun Chakraborty bear all the costs for running the social welfare organization and that he had paid the sum of Rs. 70.11 lacs as tax and after receiving the summons from E.D. he had voluntarily handed over a cheque of Rs. 1,19,88,560/-. Hence, the said organization fell in great financial distress, therefore, the amount should be refunded to the said organization.

Having examined the record we find that not only the pleadings in the writ petition are vague but no

legal right to claim the refund of the alleged amount has been disclosed in the petition. The petition is devoid of any merit which is accordingly dismissed.
