No one appear on behalf of the petitioner even on second call. On earlier occasions also no one appeared on behalf of the petitioner. This is an application under Section 401 of the Code of Criminal Procedure ,1973 challenging the judgment and order dated 18th November, 2016 passed by the learned 3rd Additional District and Sessions Judge at Brrackpore in criminal appeal No. 110 of 2015 (Surajit Rana -vs- Smt. Swapna Rana ) thereby dismissing the appeal filed by the petitioner under Section 29 of the Protection of Women from Women Domestic Violence Act, 2005 without any cost and affirmed the order dated 27.11.2015 passed by the learned Judicial Magistrate, 5th Court, Barrackpore. This is a case which is pending since 2017. However, it appears that petitioner is not interested to proceed with the case.

Accordingly, the case is dismissed for default. Interim order, if any stands vacated. Let a copy of this order be sent to the learned Court below for information.
