1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is a member of a Fair Committee. There was a dispute between the petitioner and the alleged victim, whose family has been given a stall at the fair. The petitioner has been falsely implicated in this case.
2. Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. The prosecution case is that the petitioner was a member of the Fair Committee. He went to the alleged victim and his family members, who had given a stall at the fair and asked for an exorbitant sum as subscription. This led to an altercation. The petitioner and others allegedly damaged the articles there and assaulted the victims.
Hot oil was poured on the principal victim lady. He relies on the statements of witnesses including that of the victim and the injury report.
3. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.
4. Accordingly, the application for anticipatory bail is rejected.
